REAL ESTATE Mr. Shuck has experience with a wide variety of real estate issues. Mr. Shuck has also been involved in cases including, but not limited to, foreclosures of mortgages, litigation involving Certificates of Purchase and applications for a tax deed, negotiating easements, creating easements, extinguishing easements, municipal and county land use issues, petitions to the County Commissioners for a private road, and complying with subdivision statutes. Mr. Shuck limits his landlord/tenant practice to the representation of landlords and has experience with commercial and residential leases. Mr. Shuck also prepares installment land contracts and buy/sell agreements and has assisted purchasers in performing due diligence in preparation for the purchase of ranches. Because of Mr. Shuck’s background in water and natural resources, he also advises clients with respect to state lands issues, BLM leases, mining claims, reservoirs, surface water, and ground water. See section on “Environmental/Natural Resources”. Mr. Shuck also assists clients with respect to filing of liens against real property and defense of lien foreclosure actions. See “Construction Litigation and Liens” section. Other issues involving mortgages on real property handled by the firm include redemption of property prior to foreclosure, representing lenders in foreclosure and replevin actions, and securing releases of mortgages.
